Introduction

This privacy policy ["Privacy Policy"] discloses privacy practices of CAIA SOFTWARE & SOLUTIONS, INC. (a New Hampshire corporation) [collectively, the "Company," "we," "us," or "our"] and our online service [the "Service"] and our websites, applications, and other offerings [collectively, the "Platform"]. As part of the normal operation of the Service and the Platform, we may collect and, in some cases, disclose information about you. This Privacy Policy describes information we may collect about you and what may happen to that information. By accepting our Terms of Use ["Terms"] or using the Service or the Platform, you expressly consent to our use and disclosure of your personally identifiable information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms.


1. Minors

2. Information We May Collect

(a) Your Registration Information. To fully use the Services and the Platform, you will need to register using our online registration form, where you will be required to provide us with your contact information and certain other personal information requested in the registration form.

(b) Your Usage of the Services and the Platform. We automatically track certain information about you based upon your use of the Services and the Platform. We use this information to conduct internal research on our users' demographics, interests, and behavior to better understand and serve our users. This information is compiled and analyzed on an aggregate basis, and may be anonymized or non-anonymized. This information may include the URL that you just came from, which URL you next go to, what browser you are using, and your IP address.

(c) Cookies. In addition, we use "cookies" on certain pages of the Platform. Cookies are small files that can be used to track a user's steps or automatically generate a user's password. Some features of the Service or the Platform may only be available through the use of a cookie. Among other things, cookies may allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. Cookies are stored on your hard drive, not on the Platform. Most cookies are automatically deleted at the end of a session. You may decline our cookies if your browser permits, although your use of the Services or the Platform may then be restricted (as noted above).

(d) Your Posts. As a user of the Service or the Platform, you may be able to upload and post a great variety of materials and information, including but not limited to messages, text, audio, video, photographs, graphics, and other materials ["Content"]. If you choose to upload or post Content in the Platform, we will collect such information about you as you may choose to disclose. Content that you choose to upload or post may be widely available to other users both in and outside of the Platform.

(e) Your Correspondence. If you send us emails, letters, or other personal correspondence, or if other users or third parties send us correspondence about your activities or Content on the Platform, we may collect such information into a file specific to you.

(f) Other Data. We may also collect other data that users provide, or that may be required to provide or use the Service or the Platform.


3. Our Use of Your Information

(a) Promotional Use. We may use personal information about you to enhance our marketing and promotional efforts, and to provide, personalize, maintain, and improve the Service and the Platform. We may also use your information to deliver to you advertisements, new services and promotions, and other information to you that is targeted to your interests. You may avoid receiving some of this information by changing your options on your account status page.

(b) Administrative Notices and Communications. We may use your email address, mailing address, and telephone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of the Services and the Platform. If you do not wish to receive these communications, you may have the ability to opt-out on your account status page.

(c) Customer Support. We may use information we collect to provide customer support, including to investigate and address user concerns and to monitor and improve our customer support processes and responses.

(d) Dispute Resolution. We use information in the file we maintain about you, and other information we obtain from your current and past activities on the Platform, to resolve disputes, troubleshoot problems, and enforce the Terms.

(e) Safety, Security, and Fraud Protection. We may use information to help maintain the safety, security, and integrity of the Services, the Platform, and users.

(f) Research and Development. We may use information for analysis, product and service development, research, testing, and machine learning, which may help make the Service and the Platform easier to use, enhance safety and security, and develop new products, services, and features.

(g) Enabling Communications Between Users. We may use information to enable or assist with communications between users of the Service and the Platform.

(h) Marketing and Advretising. We may use information to market our products and services, and those of our business partners.

(i) Nonmarketing Communications. We may use information to send surveys or other communications that are not for the purpose of marketing our products or services.

(j) Legal Proceedings and Requirements. We may use information to investigate or address claims or disputes relating to use of the Service and the Platform, to satisfy requirements under applicable laws, regulations, licenses, agreements, or insurance policies, or as may be requested or required by law enforcement or other government officials or court orders.


4. Quality Control and Service Monitoring

Certain services may require a call with you via telephone or videoconference. It is our policy and practice to monitor and on some occasions record calls (including calls for user transactions and customer service calls) with us for quality assurance and training purposes.


5. Changes to Your Personal Information

If any personal information you may have provided to us has changed, or should you ever notice a mistake or error with respect to any of your information on the Platform, you should promptly notify us and provide updated or correct information so that the Platform will have current and accurate information about you.


6. Our Disclosure to Third Parties

We use practices that are consistent with standards in the industry to protect your privacy. We cannot, however, promise that your personally identifiable information or private communications will remain private. For example, third parties may unlawfully intercept or access transmissions or private communications. We do not sell or rent any personally identifiable information about you to any third party without your permission. The following describes some of the ways that your personally identifiable information may be disclosed.

(a) Law Enforcement. We reserve the right at all times to disclose any information about you that we reasonably believe is necessary or appropriate to satisfy any applicable law, regulation, legal process, or governmental request, enforce the Terms or other agreements, protect the rights, property, or safety of our users, respond to a governmental authority request or legal process, or to protect against fraud. For example, and without limitation, we may disclose any information about you to law enforcement or other government officials that we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringement, or other activity that is illegal or may expose us to legal liability. We reserve the right to fully cooperate with any law enforcement authorities or other government officials or court orders requesting or directing us to disclose the identity of anyone posting any content, or publishing or otherwise making available any materials on the Platform. BY ACCEPTING OUR TERMS OR USING THE SERVICE OR THE PLATFORM, YOU WAIVE ALL RIGHTS AND AGREE TO HOLD US HARMLESS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY US DURING OR AS A RESULT OF ANY INVESTIGATIONS OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF ANY INVESTIGATION BY EITHER US OR LAW ENFORCEMENT AUTHORITIES.

(b) Advertisers. We may disclose aggregate information about our users to advertisers and for other marketing and promotional purposes. However, we do not disclose any personally identifying information to any of these entities without your authorization.

(c) The Platform. Throughout the Platform, you may be identified by your User ID. Unless you select a unique User ID, our system may automatically set your User ID as your email address. In this situation, where you are identified on the Site by your User ID, you disclose your email address to other users and third parties. As a result, other users and third parties might send you unsolicited email and be able to personally identify your activities on the Site. Although certain website pages may be coded with robot exclusion headers, others may attempt to automatically collect your email address. Even if your User ID is not your email address, your User ID may be used to identify you and your activities throughout the Platform. Other people may see the Content that you upload or post to the Platform, your feedback rating and associated comments, or other information you provide. We may also provide a number of ways to allow other users to find more information out about you, the Content, and your activities on the Platform.

(d) Third Party Suppliers. We may use third-party suppliers to assist us in providing the Services and the Platform. Whenever a third-party supplier desires to collect information about you, you will be notified of the involvement of the third-party supplier, and you will never be required to disclose any information to the third-party supplier. We impose contractual restrictions on the use by our third-party suppliers of information concerning you, and we do not permit our third-party suppliers to sell your information to other third parties without permission.


7. Use Limited to Site-Related Communications

Because of the nature of the Services and the Platform, the Platform may allow you to access other users' contact information. You may use such information only for Platform-related communications. "Platform-related communications" expressly excludes unsolicited commercial messages that are unrelated to the Services and the Platform. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances can you disclose personally identifiable information about another user to any third party without our consent and the consent of such other user after adequate disclosure. Note that law enforcement personnel, verified rights owner program participants, and other rights holders may be given different rights with respect to information they access.


8. No Spam

We do not tolerate spam. Therefore, without limiting the foregoing, you are not licensed to add any user of the Service or the Platform to your mail list (whether email or physical mail) without their express consent after adequate disclosure.


9. Disclosures You Make to Third Parties

We do not control the privacy policies of third parties. When you disclose information to third parties on any other website about yourself, you are subject to the privacy customs and policies of that third party.


10. Links to Third Party Websites

The Platform may contain, or third parties including users of the Service and the Platform may provide, links to other websites or resources that are not maintained by or related to us. Links to such third-party sites may be provided or allowed as a service and convenience in the Platform, but they are not sponsored by, endorsed by, or otherwise affiliated with the Service, the Platform, or us. Please be aware that we are not responsible for and have no control over linked third-party websites, including, but not limited to, the privacy practices of such websites, and we make no representations or warranties to you about the privacy, content, quality, or accuracy of any linked website. Therefore, you acknowledge and agree that your use of such third-party websites is entirely at your own risk and we are not responsible or liable in any way, directly or indirectly, for any of your dealings or transactions with such websites or any damage or loss caused by or alleged to have been caused by or in relation to your use of such linked websites, including any loss or damage from any privacy violation or privacy breach that may occur as a result of your use of any linked website or any failures or disruption to your computer system that results from your use of any such linked websites.
